TERMS AND CONDITIONS OF SALE
We invite you to read these general terms and conditions of sale (hereinafter ‘the GTC’) carefully, as well as our privacy policy on the protection of personal data (hereinafter ‘the Privacy Policy’), which govern our relationship should you order our products (hereinafter ‘the Products’) for sale on the website https:// www.pierreherme.com (hereinafter “the Website”) or browse the Website. You are also advised to save and/or print them. For the purposes of these T&Cs, it is agreed that ‘the Customer’ refers to the person browsing the Website and/or ordering Products on the Website, and Pierre Hermé Paris refers to the company identified in Article 1 below.
1. IDENTIFICATION OF THE SELLER
PIERRE HERME PARIS is a simplified joint-stock company with a sole shareholder, with a share capital of 703,330 euros, registered with the Paris Trade and Companies Register under number 434 851 952, whose registered office is situated at 100, Boulevard Malesherbes, Paris (75017), and whose intra-Community VAT number is FR55434851952.
2. PURPOSE
2.1. These Terms and Conditions set out the terms and conditions under which the Customer orders and purchases Products via the Website’s online shop as part of an online and mobile distance selling scheme.
2.2. It is hereby specified that the ordering of Products on the Website is exclusively reserved for consumers, that is to say, natural persons aged 18 or over (or, if they are minors, authorised by their legal representative) who are acting for purposes unrelated to any commercial, entrepreneurial, craft or professional activity they may carry out.
3. APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE
3.1. Any order for a Product offered on the Website implies that the Customer has read and expressly accepted the current Terms and Conditions, which take precedence over all previous versions and over any specifications provided by the Customer.
3.2. Prior to any transaction carried out on the Website, the Customer acknowledges that they have read the T&Cs and accept them without reservation by ticking the box ‘I have read and accept the terms and conditions of sale’ and clicking the ‘Place Order’ button.
3.3. In accordance with the applicable legal provisions relating to electronic signatures, it is hereby reiterated that the confirmation of the order form in accordance with these T&Cs constitutes an electronic signature which, between the Parties, has the same legal validity as a handwritten signature and serves as proof of the completeness of the order and of the payability of the sums due in fulfilment of said order.
3.4. These General Terms and Conditions set out the full extent of the Parties’ rights and obligations. The fact that Pierre Hermé Paris does not rely on any clause of these General Terms and Conditions at any given time shall not be construed as a waiver of the right to rely on it at a later date.
3.5. Pierre Hermé Paris reserves the right to amend these T&Cs, in whole or in part, at any time.
4. STATEMENTS
4.1. By creating an account and/or placing an order on the Website, the Customer acknowledges that they have full legal capacity to enter into a contract under these Terms and Conditions.
4.2. The Customer also declares that they are aware that they may only order Products in quantities corresponding to their needs and that their resale or transfer to a third party, for commercial or professional purposes, whether free of charge or for a fee, is expressly prohibited.
4.3. Finally, the Customer declares that, at the time of placing their order, they had read the T&Cs in force and the Product specifications, and had all the necessary information in this regard.
5. PRODUCT SPECIFICATIONS
5.1. The products offered to the Customer are those listed in the catalogue published on the Website at the time the Customer views it.
5.2. Each Product is presented alongside a photograph and a description provided by Pierre Hermé Paris. The descriptions are intended to present the essential characteristics of the Products to the Customer before the final order is placed. Pierre Hermé Paris undertakes to display photographs on the Website that are as accurate as possible; however, they may differ from the actual product, particularly in terms of colour, due to web browsers and/or monitors, as well as the nature of the Products themselves. These photographs are therefore not contractually binding.
5.3. Pierre Hermé Paris reserves the right to amend the list and specifications of the Products offered on the Website at any time, without any obligation to alter orders already in progress. Only the information printed on the Product packaging is binding on Pierre Hermé Paris. It is therefore the Customer’s responsibility, particularly if they suffer from allergies, to refer to the list of ingredients on the packaging before consumption.
6. AVAILABILITY
6.1. The Products sold on the Website are offered whilst stocks last. Product offers are therefore valid for as long as they are visible and available on the Website.
6.2. Any product that becomes permanently unavailable will be removed from the Product catalogue on the Website as soon as possible.
6.3. Furthermore, perishable Products are handmade and available in limited quantities. In addition, due to the specific origins of our ingredients and raw materials, there is a risk of stock shortages arising from a failure to source them, particularly as a result of adverse weather conditions.
6.4. Furthermore, simply adding a Product to the basket does not constitute confirmation of the order. In other words, the Product may become unavailable between the time it is added to the basket and the Customer’s confirmation of the order.
6.5. Finally, errors may occur at the time of ordering.
6.6. Should a Product ordered be unavailable for any reason whatsoever, Pierre Hermé Paris will contact the Customer by telephone or email as soon as possible to agree on either postponing the delivery, should the Product become available again, or replacing the Product with another of equivalent quality and price. If postponing the delivery or substituting the Product
is not possible, or if the Customer refuses the proposed solution, a refund for the missing Product will be issued immediately.
6.7. Orders for home delivery are prepared on the morning of dispatch to ensure the Products remain as fresh as possible. In the event that a Product is out of stock, Customer Services will contact the Customer on the morning of dispatch. In order to meet the scheduled dispatch date, the Customer must, where applicable, confirm their choice of replacement Product by 12 noon; otherwise, dispatch of the order will automatically be postponed until the following day.
6.8. For the sake of clarity, it is important to note that orders placed during festive periods (particularly the end-of-year festive season) may be subject to a higher risk of stock shortages compared with those placed at other times of the year.
7. PRICES
7.1. The applicable prices are those shown on the Website at the time the order is placed.
7.2. Pierre Hermé Paris shall not accept any claim from the Customer arising from a promotional price offered for one or more Products after the order has been confirmed.
7.3. Furthermore, Pierre Hermé Paris reserves the right to amend its prices at any time; the applicable prices shall be those in force at the time the order is confirmed, and not on the date of delivery of the Products, whether the change is an increase or a decrease.
7.4. In the event of a data entry, printing or calculation error resulting in a price significantly lower than the normal price, the Customer will be charged the lower price unless that price is manifestly derisory – that is to say, bears no relation to the actual value of the Product ordered. In this case, the order, even if it has been automatically confirmed by Pierre Hermé, will be cancelled. The Customer will be informed as soon as possible so that they may, if they wish, place a new order at the correct price.
7.5. The prices shown are in euros, inclusive of VAT.
7.6. The VAT included is the French VAT rate applicable on the date of the order. Should the VAT rate change, such changes will be reflected in the price of the Products. In the event of delivery outside France, the applicable VAT will be that of the country of delivery.
7.7. Delivery charges include the cost of high-quality packaging provided by
Pierre Hermé Paris.
7.8. Delivery charges are invoiced in addition to the price of the goods. Delivery rates depend on the chosen delivery method (home delivery or courier delivery), as well as the geographical area, weight and volume of the parcel, as detailed in the section ‘Delivery of Products’ (Article 11 below), and are confirmed prior to the final confirmation of the order.
8. CUSTOMER ACCOUNT
8.1. Logging in or creating an account
8.1.1. Orders may be placed on the Website either via a ‘Guest Account’ or by opening a Customer Account.
8.1.2. To create an account and/or log in if they have already registered, the Customer must provide an email address and a password. These details are and must be kept confidential. If the Customer loses their password, they may click on the ‘Forgotten password’ link and enter their email address. The Customer will receive a new password at their email address. The Customer may also make a request by email to Customer Services, whose contact details are set out in the ‘Customer Services’ section (Article 13 below), which will reply exclusively by email to the address used when creating the Customer Account.
8.1.3. The Customer’s password is not used under any circumstances to make any payments.
8.1.4. The Customer is required to provide additional information to complete their registration (title, surname, first name, date of birth).
8.1.5. By creating an account, the Customer acknowledges that they have read and unreservedly accept the Terms and Conditions of Sale as well as the Personal Data Protection Policy.
8.2. Use of the account
8.2.1. The Customer may view the details of their current order by clicking on ‘My Basket’. The order and invoice history can also be viewed at any time under the ‘My Orders’ sub-section of the ‘My Account’ section. The history is retained on the Website for several months.
8.2.2. The Customer shall be solely liable for the consequences of using their account until such time as it is deactivated.
8.2.3. In the event of the Customer’s failure to comply with the Terms and Conditions, Pierre Hermé Paris reserves the right to deactivate the Customer’s account, as of right and without compensation, following the sending of an email or a registered letter with acknowledgement of receipt, which has remained unanswered for more than 30 days. In the event of a proven breach or serious fraud on the part of the Customer, their account will be deactivated with immediate effect, without prior notice, without formalities and without compensation.
8.2.4. Any Customer wishing to deactivate their account must notify Pierre Hermé Paris by email or by registered letter with acknowledgement of receipt addressed to Customer Services, whose contact details are set out in the ‘Customer Services’ section (Article 13 below). Pierre Hermé Paris undertakes to deactivate the account within a maximum of 15 days from receipt of such correspondence.
9. ORDER
9.1. After selecting the desired Product(s), the Customer places their order in accordance with the instructions on the Website. A summary of the order is then displayed, setting out all the details. The Customer then confirms the order by clicking on the ‘Confirm my basket’ button. The Customer then selects their delivery method and billing address in accordance with the terms set out in the ‘Delivery of Products’ section (Article 11 below). Finally, the Customer proceeds to pay for the order in accordance with the terms set out in the ‘Payment’ section (Article 9 below).
9.2. To place an order, the Customer must complete all the fields required for the order to be processed correctly:
- Selection of the Product(s)
- Selection of the billing address
- Selection of the delivery address (for home delivery or
courier delivery)
- Choice of delivery date
- Choice of payment method
- Review and confirmation of the order and the General Terms and Conditions of Sale
9.3. This information is required for the processing of orders and for the commercial relationship between Pierre Hermé Paris and the Customer. Consequently, failure to provide the requested information is tantamount to cancelling the order.
9.4. Furthermore, the Customer undertakes to provide true and accurate information and to inform Pierre Hermé Paris of any changes to such information.
9.5. Pierre Hermé Paris shall not be held liable for any data entry errors or the consequences arising therefrom, such as a delay and/or an error in delivery. In this context, all costs incurred in resending the order shall be borne entirely by the Customer in accordance with the terms set out in the section ‘Delivery of Products’ (Article 11 below).
9.6. Pierre Hermé Paris will confirm the order and its payment:
- On the Website, following payment;
- By email, to the email address provided by the Customer.
The order confirmation will include, in particular:
- the details of the Product(s) ordered;
- the price including VAT;
- where applicable, any issues or reservations relating to the order placed.
9.7. Pierre Hermé Paris reserves the right not to confirm an order, in particular in the event of payment authorisation being refused by officially accredited bodies, non-payment of a previous order or an ongoing dispute with the Customer, or in the event of a problem with the order received, an order that is irregular or incomplete for any reason whatsoever, a foreseeable problem concerning the supply of the Product, or where a withdrawal or recall procedure has been initiated concerning one or more of the Products ordered. Pierre Hermé Paris will inform the Customer of this by email within 48 working hours of the order being placed online.
9.8. Changing an order
For any changes to an order, such as:
- billing address
- delivery address
- delivery date or time
- order contents
The Customer must contact Customer Services by telephone only, no later than:
- Courier delivery and in-store collection: by 4.00 pm on the day before the collection date or the courier delivery date
- Home delivery in France: 2 working days before the desired home delivery date
- Home delivery to Corsica and internationally: 3 working days before the desired home delivery date
No requests for changes can be accepted for orders due for collection in-store on the day of collection.
Once the deadlines mentioned above have passed, Pierre Hermé Paris cannot guarantee that changes will be possible. Furthermore, given the time taken to process emails sent to Customer Services, Pierre Hermé Paris cannot guarantee that requests for order changes made via this channel will be taken into account.
9.9. In the event of an order cancellation:
In the event of an order cancellation, the following conditions apply:
- Cancellation of an order no later than 48 hours before the delivery or collection date: a credit note or a refund will be issued by Customer Services, at the Customer’s discretion;
- Cancellation of an order no later than 24 hours before the delivery or collection date: only a credit note for the value of the cancelled Products will be issued by Customer Services. No refund will be possible;
- Cancellation of an order less than 24 hours before the delivery or collection date: no refund or credit note will be issued by Customer Services.
10. PAYMENT
10.1. Payment for the Products is made by VISA, MASTERCARD or AMERICAN EXPRESS credit card, online via the Website. Credit card payments are authorised immediately.
10.2. The Customer warrants to Pierre Hermé Paris that the credit card used is valid and has not been obtained fraudulently.
10.3. Payments are secured by the Payplug solution, in accordance with French and international interbank regulations. This solution enables the Customer to make purchases in complete security. When paying for their order online, the Customer is automatically redirected to the bank’s server via a transaction secured by SSL (Secure Sockets Layer) encryption (128-bit session key, in accordance with French Government authorisations). The card number is thus encrypted between the browser and the bank’s server. Under no circumstances does Pierre Hermé Paris receive, record or store any information whatsoever relating to the Customer’s banking details. Payment is therefore 100% secure.
10.4. To be registered, the order must be paid for in full. Unpaid orders cannot be processed.
10.5. Furthermore, Pierre Hermé Paris reserves the right to suspend any order or delivery in the event that payment authorisation is refused by the financial institutions.
10.6. An invoice is sent to the Customer following payment. The invoice includes the details provided by the Customer in their Customer account. The Customer is free to amend these details at any time. The invoice can be downloaded directly from the Customer account.
11. RIGHT OF WITHDRAWAL
11.1. In accordance with the legislation in force (Articles L.221-18 et seq. of the Consumer Code), the right of withdrawal does not apply to contracts relating to the supply of perishable food products.
11.2. Accordingly, Pierre Hermé Paris draws the Customer’s attention to the fact that, in accordance with current legislation, the purchase of the following excluded products does not allow for the exercise of the 14-day right of withdrawal:
(i) goods made to the consumer’s specifications or clearly personalised: this applies in particular to orders for pyramids of
macarons, tiered desserts, rectangular desserts, birthday cakes, cascading cakes, central stands, pyramids of choux pastries, Yule logs and macaron boxes;
(ii) fresh products, and products likely to deteriorate or expire rapidly, such as macarons, chocolates, pastries, Viennese pastries, dry baked goods, cakes, waffles, confectionery, spreads, jams, ice creams and sorbets, and drinks;
(iii) goods unsealed by the Customer after delivery and which cannot be returned for reasons of hygiene or health protection.
11.3. For other Products, pursuant to Article L221-18 of the Consumer Code, the Customer has a period of fourteen (14) days from receipt of the Product to exercise their right of withdrawal with Pierre Hermé Paris, without having to give any reason or pay any penalty, in order to obtain a refund. If this period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the next working day.
11.4. The right of withdrawal may be exercised on plain paper or by email by sending the following to Customer Services, whose contact details are set out in the ‘Customer Services’ section (Article 13 below), before the expiry of the withdrawal period:
- Their name and postal address and, where available, their telephone number and email address;
- Their decision to withdraw, using the model withdrawal form provided in Appendix 1 of the T&Cs or by means of any unambiguous statement addressed to Customer Services, by post, email or telephone.
11.5. If the request is sent by email, Pierre Hermé Paris will send the Customer an acknowledgement of receipt.
11.6. Products must be returned within fourteen (14) days of Pierre Hermé Paris being notified of the Customer’s decision to withdraw from the contract, accompanied by the purchase invoice, in their original packaging and in perfect condition so that they can be resold as new. Products that are damaged, soiled or incomplete as a result of the Customer’s handling, other than that necessary to establish the nature and characteristics of the Product in question, will not be accepted.
11.7. Returns must be sent to Customer Services, whose contact details are set out in the ‘Customer Services’ section (Article 12 below).
11.8. In the event of a promotional offer consisting of one or more free gifts provided with an order placed on the Website, the right to withdraw from all or part of the order will only be validly accepted if the Customer also returns the gift(s) provided. Only gifts returned in perfect condition, properly protected and in their original, undamaged packaging will be accepted.
11.9. Should the right of withdrawal be exercised within the aforementioned time limit, only the price of the Product(s) purchased and the delivery charges will be refunded; it should, however, be noted that Pierre Hermé Paris is not obliged to refund any additional costs if the Customer has expressly chosen a delivery method that is more expensive than the standard delivery method offered by Pierre Hermé Paris; the costs of returning the goods shall be borne by the Customer.
11.10. The exchange or refund will be processed via the payment method used by the Customer, without undue delay and, in any event, no later than fourteen (14) days from the date on which Pierre Hermé Paris is notified of the Customer’s decision to withdraw.
11.11. For any further information regarding the scope, content and instructions on how to exercise the Customer’s right of withdrawal, the Customer may contact Customer Services, whose contact details are set out in the ‘Customer Services’ section (Article 14 below).
11.12. Except in the case of withdrawal in accordance with the conditions set out above or unless otherwise agreed between the Parties, Products may not be refunded or exchanged once they have been ordered.

12.1.7.4. To track the status of their delivery, Pierre Hermé Paris invites the Customer to visit the carrier’s website directly (www.chronopost.fr) using the tracking number provided to them by email when their parcel was dispatched.
12.1.8. DELIVERY INFORMATION AND ADDRESSES
12.1.8.1 The Customer is responsible for providing the recipient’s name and address. This information must be precise, accurate and complete (including door code and floor number) to enable the Products to be delivered in accordance with the terms specified at the time of ordering.
12.1.8.2 Pierre Hermé Paris shall under no circumstances be held liable for a returned delivery due to an incorrect address or an inability to deliver to the address provided.
12.1.8.3. In the event that a delivery address is incomplete or inaccurate, Pierre Hermé Paris reserves the right to contact the recipient directly by telephone to complete the missing delivery details with them, provided that the telephone number is correct and the recipient is available. Should this be the case, the recipient will be charged delivery charges. If the delivery driver is unable to contact the customer, the customer will not be entitled to a refund of the delivery charges.
12.1.8.4. Orders specifying a PO box address cannot be accepted or processed.
12.1.8.5. The Customer agrees to provide proof of identity, should the carrier request it, by presenting a valid official document and, if necessary, providing the order number sent to them in the order confirmation email.
12.1.8.6. If the Customer is unable to collect the order in person, they must authorise a third party to act on their behalf, providing that person with a letter of authorisation and a photocopy of the Customer’s identity card.
12.1.8.7. No request for delivery of the parcel will be honoured if the Customer fails to comply with the conditions set out above.
12.1.8.8. If the recipient or a person authorised to take delivery of the Products is absent at the time of delivery, and provided the carrier has access to the recipient’s letterbox, the carrier will contact the recipient to reschedule a second and final delivery attempt.

12.1.8.10. Under no circumstances shall Pierre Hermé Paris be held liable for any deterioration of the Products resulting from their late collection from the carrier.
12.1.8.11. In the event of a delay in delivery for reasons beyond the Customer’s control, where the delay exceeds 96 working hours or where the delay results in the delivered Products having a use-by date of no more than two days remaining, Pierre Hermé Paris shall redeliver to the Customer and replace any Products that are no longer fit for consumption. The delivery will be rescheduled in consultation with the Customer as soon as possible. If the Customer does not wish to have the Products replaced, a refund will then be issued.
12.2. In-store collection
12.2.1. In the case of an order placed for in-store collection, the Customer undertakes to collect their order from the Pierre Hermé Paris shop on the date and within the time slot they have chosen.
12.2.2. Where the Products are perishable, Pierre Hermé Paris will not be able to hold an order that has not been collected by the Customer. An uncollected order will not give rise to a refund.
12.2.3. The option of 2-hour in-store collection applies only to the following Products: macaron boxes, chocolate boxes, snacks, chocolate bars, cakes, brioches, as well as teas and jams.
12.3. Courier delivery
12.3.1. The courier delivery service is available for purchases of €35 or more (including VAT). For courier delivery, the Customer is responsible for providing the necessary details, in particular the door code, floor number and their telephone number. Furthermore, the Customer must remain contactable by telephone. If the courier is unable to contact the Customer, the Products cannot be delivered and the Customer will not be entitled to a refund of the order or the delivery charges.
12.3.2. The person named as the recipient of the delivery will automatically receive a first text message 24 hours before delivery, followed by a second text message on the day of delivery. Therefore, if the order is a gift and the Customer wishes it to be a surprise, they must specify a different telephone number to that of the recipient in the delivery details form.
12.3.3. If the recipient is absent or cannot be contacted, the Products will be returned to the nearest shop and will not be delivered again. Where the order consists of perishable Products, Pierre Hermé Paris will not be able to store the order and will dispose of them. The Customer may not make any claim for a refund or request a replacement.

12.3.5. If the Customer is offered, and accepts, a redelivery or a credit note, no refund will be issued.
12.3.6. Delivery by courier is carried out within a two-hour time slot chosen by the Customer. However, the courier reserves the right, in the event of strikes or public holidays (Christmas and New Year’s Day), to deliver within a three-hour time slot.
12.3.7. Delivery times cannot be guaranteed during festive periods such as Christmas, Easter, Valentine’s Day, Mother’s Day, etc. During these periods, only orders that are more than 2 hours late beyond the original time slot will be eligible for a refund if the delay is attributable to Pierre Hermé Paris.
12.3.8. Pierre Hermé Paris reserves the right to refuse to dispatch certain Products during periods of high temperatures.
12.3.9. In the event of a failure to deliver or a delay in delivery in any circumstances other than those referred to above, and provided that this is not attributable to the Customer, the order may then be cancelled and the Customer may obtain a refund of the price paid, to the exclusion of any other compensation or damages.
12.3.10. Courier delivery charges: the courier delivery service is available for purchases of €35 or more (including VAT).
Weekdays (Monday to Saturday): Zone 1 (Paris) €18 (including VAT) // Zone 2 (92-93-94) €37 (including VAT) // Zone 3 (77-78-91-95) €68 including VAT

13. COMPLAINTS AND REFUNDS
13.1. The Customer must ensure that their order is correct upon delivery, or upon collection in the case of an ‘In-Store Collection’ order. To be considered, any complaint must be made within 48 hours of receipt of the Products. The receipt or online order confirmation must be presented for any complaint to be valid. No goodwill gesture or refund will be granted without the presentation of the aforementioned proof of purchase. The Customer may be asked to provide additional information in connection with their complaint, including: order number, photographs, etc.
13.2. Complaints should be addressed to: Customer Services, whose contact details are set out in the ‘Customer Services’ section (Article 14 below).
13.3. Complaints or disputes will always be considered with careful consideration, as good faith is always presumed on the part of the person taking the trouble to raise the issue.
13.4. In the event of a dispute for which Pierre Hermé Paris is liable and which justifies a refund of all or part of the order, the Customer will receive notification by email within 21 days of the complaint being made.
13.5.1. In the case of non-perishable Products, the Customer must return the Products and Pierre Hermé Paris will issue a refund within fourteen (14) days of the return of the Products or proof of their return.
13.5.2. If the Products are perishable, their return will not be required, except in specific circumstances (for example, a health investigation), and a refund for the Products will be issued within the following timeframes:
Online orders:
- For refund requests made by telephone: the fourteen-working-day period begins on the day the call is made.

16. LIABILITY
16.1. Conformity of the Products

If the Customer finds that one or more Products are missing or that one or more Products have been damaged, it is the Customer’s responsibility to enter the customary reservations in writing with the carrier on the delivery note and to refuse delivery, and then to inform Customer Service immediately, using the contact details given in the “Customer Service” section (Article 14 above). Where appropriate, Pierre Hermé Paris will replace the missing or damaged Products with identical Products.
16.1.2. Pierre Hermé Paris insures the Products until they are collected, in the case of an order for Boutique Collection, or until they reach the place of delivery, in all other cases. Appendix 2 – Statutory provisions applicable to the legal warranties
The consumer has a period of two years from delivery of the goods to enforce the statutory warranty of conformity if a lack of conformity appears. During this period, the consumer is required to establish only the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale for the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the statutory warranty applies to that digital content or digital service throughout the period of supply provided for. During this period, the consumer is required to establish only the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The statutory warranty of conformity obliges the trader, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The statutory warranty of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the consumer’s request, free of charge and without major inconvenience to the consumer.
If the goods are repaired under the statutory warranty of conformity, the consumer benefits from a six-month extension of the original warranty.
If the consumer requests repair of the goods but the seller imposes replacement, the statutory warranty of conformity is renewed for a period of two years from the date of replacement of the goods. The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:
1° the trader refuses to repair or replace the goods;
2° the repair or replacement of the goods takes place after a period of thirty days;
3° the repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° the lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or immediate termination of the contract. The consumer is then not required to request repair or replacement of the goods beforehand.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for the purposes of repair or replacement suspends the warranty that remained to run until the goods are returned in a repaired condition.
The rights set out above arise from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.
A seller who, in bad faith, obstructs the enforcement of the statutory warranty of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the Consumer Code).
The consumer also benefits from the statutory warranty against latent defects pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.
